LONG BEACH, Calif. (AP) ? A former high school football star whose dreams of a pro career were shattered by a rape conviction burst into tears Thursday as a judge threw out the charge that sent him to prison for more than five years.

Brian Banks, now 26, pleaded no contest 10 years ago on the advice of his lawyer after a childhood friend falsely accused him of attacking her on their high school campus.

In a strange turn of events, the woman, Wanetta Gibson, friended him on Facebook when he got out of prison.

During an initial meeting with him, she said she had lied; there had been no kidnap and no rape and she offered to help him clear his record, court records state.

But she refused to repeat the story to prosecutors because she feared she would have to return a $1.5 million payment from a civil suit brought by her mother against Long Beach schools.

During a second meeting that was secretly videotaped, she told Banks, "'I will go through with helping you, but it's like at the same time all that money they gave us, I mean gave me, I don't want to have to pay it back,'" according to Freddie Parish, a defense investigator who was at the meeting.

It was uncertain whether Gibson will have to return the money and unlikely she would be prosecuted for making the false accusation so long ago, when she was 15.

Gibson did not attend the hearing and she could not be reached for comment. Prosecutors and defense attorneys said they were unable to find her recently.

Banks, once a star middle linebacker at Long Beach Polytechnic High School, had attracted the interest of such college football powerhouses as the University of Southern California, Ohio State University and the University of Michigan, according to the website Rivals.com, which tracks the recruiting of high school football and basketball players.

Banks said he had verbally agreed to attend USC on a scholarship when he was arrested.

He still hopes to play professional football and has been working out regularly. His attorney Justin Brooks appealed to NFL teams to give him a chance.

"He has the speed and the strength. He certainly has the heart," Brooks said. "I hope he gets the attention of people in the sports world."

Gil Brandt, an NFL draft consultant, said Banks would be eligible to sign with any team that might show interest. However, his years away from the game will be hard to overcome.

"History tells us guys who come back after one or two years away when they go into the service find it awfully hard," Brandt said. "And this has been much longer a time."

Brandt compared the challenge to someone who has been out of high school for years trying to get an A in their first class in college.

Banks said outside court that he had lost all hope of proving his innocence until Gibson contacted him.

"It's been a struggle. But I'm unbroken and I'm still here today," the tall, muscular Banks said, tears flowing down his face.

He recalled being shocked and speechless on the day Gibson reached out to him after he had been released from prison, having served five years and two months.

"I thought maybe it wasn't real," he said. "How could she be contacting me?"

He said he knew that if he became angry when he met with her it wouldn't help, so he struggled to keep calm.

"I stopped what I was doing and got down on my knees and prayed to God to help me play my cards right," he said.

In court, Deputy District Attorney Brentford Ferreira told Superior Court Judge Mark C. Kim that prosecutors agreed the case should be thrown out. Kim dismissed it immediately.

Banks had tried to win release while he was in prison, but Brooks, a law professor and head of the California Innocence Project at California Western School of Law in San Diego, said he could not have been exonerated without the woman coming forward and recanting her story.

Brooks said it was the first case he had ever taken in which the defendant had already served his time and had been free for a number of years.

Banks remained on probation, however, and was still wearing his electronic monitoring bracelet at the hearing. His lawyer said the first thing the two planned to do was report to probation officials and have it removed.

"The charges are dismissed now," Brooks said. "It's as if it didn't happen. ... It was the shortest, greatest proceeding I've ever been part of."

Banks had been arrested after Gibson said he met her in a school hallway and urged her to come into an elevator with him. The two had been friends since middle school and were in the habit of making out in a school stairwell, according to court papers.

There were contradictions in Gibson's story, as she told some people the rape happened in the elevator and others that it happened in the stairwell.

A kidnapping enhancement was added to the case because of the allegation Banks had taken her to the stairwell. That enhancement also was thrown out Thursday.

Outside court, Banks donned a sweat shirt that read "Innocent," as several friends and family members wept. His parents were jubilant, and Banks thanked them for standing by him.

"I know the trauma, the stress that I've been through, but I can't imagine what it's like to have your child torn from you," he said. "I don't know what I would have done without my parents."

Magma crystals hold clues to volcanic eruptions

By peering at crystals encased within volcanic rock, scientists could get a better idea of when eruptions will occur, researchers say.

More than 500 million people live close to volcanoes that could erupt with little or no clear warning, causing widespread devastation and even global effects on climate, as in the case of the 1991 eruption of Mount Pinatubo. Although scientists keep an eye on many of the world's volcanoes for ground movements, gas emissions and other signs of unrest, volcanologists still face challenges directly linking surface activity with volcanic plumbing changes deep underground.

To learn more about volcanic activity in an effort to help predict it, researchers investigated the magma from within volcanoes. Crystals often grow within magma chambers, large crevices of searing hot fluid rock beneath volcanoes.

"Crystals can be thought of like a book," said researcher Kate Saunders, a volcanologist at the University of Bristol in England. "If we understand how to read them, they contain vital information on formation of the magma." Changes in magma behavior recorded in crystals might in turn shed light on volcanic activity. Crystals within magma often grow in concentric zones. This makes them like tree rings ? thin ones reflect times of little growth, while thick ones represent much growth. Each zone also has a subtly distinct chemical makeup that mirrors changes in physical conditions within magma chambers, thus giving clues on internal volcanic activity.

Saunders and her colleagues analyzed orthopyroxene crystals within volcanic rocks taken from nine different eruptions at Mount St. Helens in Washington state, from 1980 to 1986. The volcano is best known for its spectacular eruption in 1980.

The researchers discovered the rims of the crystals typically grew within 12 months of each eruption. Peaks in crystal growth were linked with increased earthquake activity and flow of sulfur dioxide gas at the volcano.

"Such a correlation between crystal growth and volcanic seismicity has been long anticipated, but to see such clear evidence of this relationship is remarkable," Saunders told OurAmazingPlanet.

Volcano vital signs
Although this work cannot lead scientists to predict the time and day of an eruption, "the more we understand the internal workings of a volcano, the better idea we have," Saunders said. "You wouldn't ask a doctor to predict the exact time of someone's death. However, by monitoring a patient's vital signs, they are able to provide a much more thorough diagnosis.

"The same is also true with volcanoes. The more we know about the processes that occur beneath them and the time scales over which these occur, the better we can anticipate their behavior and timing of future eruptions."

The researchers hope to examine other volcanoes and compare their results with other volcano-monitoring techniques.

The best plan, Saunders said, may be to collect rocks from eruptions "50 years, 100 years, 1 million years ago and interrogate these samples to investigate whether the volcano is behaving in a similar predicable manner and whether we can use this knowledge to help us to watch for similar signs in the monitoring record."

Saunders and her colleagues detail their findings in Friday's issue of the journal Science.

Prosperity Shortfall Puts Obama at Risk; But Romney's Not Yet Seized the Day

Americans are nearly twice as likely to say they've gotten worse off as better off under Barack Obama's presidency, a prosperity shortfall resembling the one that cost the first President Bush his job in 1992. But Mitt Romney has yet to seize the opportunity fully, with weaknesses on personal as well as professional qualities that are keeping the 2012 race a close one.

With the economy by far the top election issue, it's notable that Obama's staying competitive in vote preferences despite his poor ratings for economic stewardship. One reason is that George W. Bush continues to take more of the blame for the economy's problems; another, that Romney hasn't made the case he'd do better.

Just two in 10 in this survey, produced for ABC by Langer Research Associates, think they'd be better off had Romney been steering the economy instead of Obama; about as many think Romney would have left them worse off. While that's a bit (8 points) fewer than the number who say they've gotten worse off under Obama, nonetheless Obama and Romney remain essentially even in trust to handle the economy (46-47 percent) or job creation (47-44 percent).

That said, Romney has inched closer to Obama on the key question of who better understands the economic problems of average Americans, halving a 17-percentage point Obama lead in February to 8 points now. And while blame for the economy still falls more on Bush than on Obama, that's narrowed to 49-34 percent - a still-substantial 15-point margin, but down from 25 points in January. The more Obama takes the blame, the greater his risk.

Another factor: Obama's overall job approval rating, now back under 50 percent (47 percent approve, 49 percent disapprove) after hitting the halfway mark last month for just the second time since the killing of Osama bin Laden.

PUSHBACK - While these results reflect Romney's opportunities, this poll finds Obama well ahead on other measures - enthusiasm for his candidacy, views of his personal character and a sense he stands up for his beliefs - that provide him with room to push back against his vulnerability on the public's long-running economic discontent.

Even as Americans divide about evenly between the two in vote preferences, Obama does 18 points better than Romney in enthusiasm among his supporters, including a more than 2-1 advantage in the number who say they're "very" enthusiastic - 48 percent of Obama's backers, vs. 23 percent of Romney's. That reflects a problem for Romney especially in his own party: just 29 percent of his Republican supporters are very enthusiastic about his candidacy. Far more Democrats who back Obama, 61 percent, do so very enthusiastically.

The two candidates are roughly even, 47-43 percent, in views of who "better represents your personal values." But Obama leads Romney by 52-38 percent in the sense he has the better personal character to serve as president and by 51-38 percent in views that he's more apt to stand up for his beliefs. Those results underscore the advantage in personal popularity Obama's relying on to balance views of his economic performance.

It may be tough, because among issues, the economy remains the 800-pound gorilla of this election. In an open-ended question, 52 percent name the economy and jobs as the single most important issue in their vote; all other mentions are in the single digits. Among individual economic issues, unemployment is the chief concern, again by a wide margin.

VOTE PREFERENCE - All told, 49 percent of registered voters in this survey back Obama for re-election while 46 percent prefer Romney. That difference is not statistically significant, nor is the change from last month's 51-44 percent. Still it puts Obama numerically back under half, a level he's cracked just twice, in April and in February, in ABC/Post polls the past year.

While overall preferences are fairly steady, the gender gap has narrowed. Obama leads by 7 points among women who are registered to vote, 51-44 percent, compared with 57-38 percent in April. (It's now a 47-49 percent Obama-Romney contest among men.) The change chiefly is due to married women, who went from a scant 4-point tilt toward Obama last month to a 38-55 percent split in Romney's favor now.

A movable group, married women were instrumental in George W. Bush's re-election in 2004. While they shifted toward Obama last month after a period of debate about women's rights, their disapproval of his handling of the economy more recently has grown. And married women are more apt than men, or other women, to say they've gotten worse off rather than better off under Obama's presidency.

A challenge for Romney, meanwhile, is the continued deficit of Republican loyalists. On average across 2003, 31 percent of Americans identified themselves as Republicans, their highest annual average on record in ABC/Post polls since 1981. That's fallen off since, averaging 24 percent this year, and about the same, 22 percent of all adults (and 25 percent of registered voters) in this survey. Thirty-two percent of adults identify themselves as Democrats, with independents outnumbering both groups, as they have almost continuously for the past three and a half years.

In other registered voter groups, Obama leads among college graduates (52-44 percent), as he has at least numerically in 10 of a dozen polls this election cycle; notably, Obama and Romney are about even among white college graduates, 47-49 percent, while Romney leads by 24 points among whites who've not obtained college degrees. Romney leads among whites by 16 points overall, and by 9 points among registered voters with household incomes of $100,000 or more. Obama leads among nonwhites by 58 points, a margin he's held consistently.?

ECONOMY/VOTE - Economic views are integral to candidate support, and there Obama is holding the middle ground. Registered voters who say their financial situation has remained about the same under his presidency favor Obama over Romney by 60-35 percent. Naturally Obama does even better, 78 percent support, among those who are better off; Romney gets an identical 78 percent of those who are doing less well.

Similarly, Obama wins a majority, 58 percent, of registered voters who say the economy is simply "not so good," another example of the incumbent holding the more lightly disgruntled center. Romney jumps to 74 percent among those who say the economy is in poor shape. (It should be noted that partisanship helps shape economic views; Democrats currently are more positive in their economic ratings, Republicans more negative.)

The debate over Romney's work at Bain Capital does not look to be helping either candidate; Americans divide, 21-21 percent, on whether they see his background buying and restructuring companies as a major reason to support or to oppose him. Most say it's not a major factor.

That said, as in previous ABC/Post polls, Obama's got an advantage in the broader debate over economic fairness. The public by 56-34 percent says unfairness in the economic system that favors the wealthy is a bigger problem than over-regulation that inhibits growth and prosperity. And that result cuts sharply to vote preference: Registered voters who see unfairness as the main problem back Obama by 73-23 percent; those who blame over-regulation favor Romney, 78-17.

Americans divide much more closely on whether or not the system gives them a fair chance to get ahead, 48-47 percent - hardly a resounding affirmation of the American dream (and an assessment largely based on household income). Nonetheless more say they're hopeful rather than anxious about their personal finances and the national economy alike in the years ahead, with optimism boosting Obama, while anxiety works for Romney.

Separately, Romney's comparatively weak score on "personal character" appears to reflect his long-running difficulties establishing a personal rapport with the public. Improving that connection - and through it taking fuller advantage of Obama's vulnerability on the economy - are Romney's key tasks in the campaign ahead.

METHODOLOGY - This ABC News/Washington Post poll was conducted by telephone May 17-20, 2012, among a random national sample of 1,004 adults, including landline and cell-phone-only respondents. Results have a margin of sampling error of 3.5 points for the full sample and 4 points for registered voters. Food Network Star Recap: May 20, 2012 from Tv Food and Drink ...

I think tonight?s unfortunately bland ?Bus Tour? episode of Food Network Star?can be summed up by the amount of times the participants gave each other the ?swirly finger.?
You know the ?swirly finger,? right? ?You put your index finger up in the air and swirl it around as a silent way of saying to someone else, ?Yo dude? wrap it up. ?It?s officially boring now.?
Television producers crouching behind cameras often give the ?swirly finger? to their red carpet host who?s about to go one question too many with Jim Belushi. ? Mommies give it to the mall Santa when their kid moves away from Legos and skateboards and starts asking for live panda bears and a career like P. Diddy?s.

As for me, I was giving the ?swirly? to my television about 25 minutes into this episode.

This new format of dividing the competitors into three smaller teams, each led by a celebrity mentor has proven itself, in only two episodes, to be a critical mis-step for the show. ?Here?s why:

1.) I said it last week, and I?ll say it again? I DON?T CARE OF GIADA BEATS BOBBY, OR IF BOBBY BEATS ALTON. ?They each make more money at a Saturday Barnes and Noble signing than I do all year. ?Short of threatening to give their kids Mike Tyson face tattoos if they lose, I will never believe any of them care anything about ?the win.?

2.) Breaking the 15 competitors into smaller teams of five, I feel, has taken out a great chunk of the intimidation factor. ?Think about it? what would make you sweat more? going up against a gang of 4, or a gang of 14?

Watching these competitors scream obscenities at one another as they fight over the meager amounts of ingredients on hand in what has got to be the worst stocked kitchen in all of television is a huge part of the fun. ?I like seeing the challenges bring out the worst in these players.

But because of this new format, each team is separated from one another for almost the entire episode, so they don?t even get to lay eyes on the very people they?re told to compete against, much less insult them, trip them as they?re running across the kitchen, or over-salt their bouillabaisse when no one?s looking.

Even worse, within the teams there seems to be a slowly blossoming ?support mentality? taking hold. ?I don?t know about you, but I don?t want to watch these contestants help one another and offer consoling shoulders when they under-perform. ?I want to see the 1950s telephone operator push a carving knife up against Rock and Roller?s throat for swiping the last parsnip off her work station. ?I want to see Pucker Lips Justin rip that irritating nose ring out of Michele?s face. ?I want raised voices and words like ?backstabber? and ?manipulator? tossed about freely. ?I don?t need to watch a group of people suppress their petty jealousies and pretend to get along with each other for two full hours. ?I?ve got family holidays for that.

3.) Where?s our villain? ?Last season, we had that fabulous ?Bitch on Wheels? Penny. ?I can?t say I ever once wanted her to win, but I relished hating her for enough episodes so that I could ultimately take great satisfaction when the judges finally knocked her legs out from under her. ?We have no one even approaching that spot so far this season. ?I got the impression last week either Nikki or Martita might be heading for the ?love to hate? title, but everyone is so isolated from one another, there?s no opportunity for them to even work up enough venom to spit.

In short, there?s an appalling lack of drama on this season?s Food Network Star, and the blame can be pointed squarely at the decision to copy the ?celebrity mentor? format of NBC?s The Voice. ?Hopefully, it will be rectified soon and the remaning competitors will be merged back into one giant dysfunctional ball? competing in a space that?s just a little too small for them, with the heat turned up just a little too high, and the kitchen floors greased just enough with an invisible layer of Crisco. ?Otherwise, it?s going to be a long, painful season for all of us.

Challenge #1 - Each team is assigned a different New York neighborhood known for a specific type of cuisine. ?After visiting each neighborhood, each contestant must return to the kitchen and create a dish inspired by it, then present it to the judges and a group of guinea pig ?test-eaters? on a local bus tour.

Here are the highlights:

Justin has pretty lips, but no personality and likes to dress like a 1970?s wedding DJ.

1950s Phone Operator Emily forgets to eat and nearly throws up on everyone during her bus presentation.

Martie still likes to party.

Michele goes on and on about how much she hates ?bottom-feeding? catfish, then makes a bunch of it and pretends to like it to trick other people into eating it.

Judson gets assigned pickles as his dish?s main ingredient. ?Alton tells him to ?embrace the pickle.? ?Everyone purses their lips and looks down at their feet.

Kara gets nervous while presenting and refers to ?African Americans? as ?blacks,? which makes Judge Susie Fogelson wince. ?Also, her chicken and waffles dish tasted like she got it out of the frozen food section at the Piggly Wiggly.

Linkie is afraid to make cannolis.

Yvan makes a mozzarella anitpasti that has no flavor.

Josh plans to ?rock and roll? his Italian sausage story, but instead presents a meandering 15 minute narrative that has something to do with how Robert DeNiro and Joe Pesci first met. Everyone is bored, and Giada promises never again to pick someone for the show because of his cute butt and super-cool sideburns.
Judge Bob announces that Martita is ?just so likable!? ?Everyone purses their lips and looks down at their feet.

In the end, the members of Team Giada won the Bus Challenge and were all saved from elimination. ?Heading to the Producer?s Challenge Elimination Cook-off?were Kara and Judson. Their final challenge was to create an interesting dish with ? I kid you not ? potatoes. ?Not sweet potatoes, not Himalayan Wombat Potatoes, not Mr. Potato Head dolls. Just plain old potatoes. And there was still thirty minutes to go.

Kara made twice-baked potatoes ?with a twist!? ?What was the grand mysterious M. Night Shyamalan?element to her meal, you may ask? ?Was it that they were creamy? ?Was it that she added bacon? ?Was it that her mommy makes them for her every year on her birthday?

It was never made clear.

Regardless, Judge Bob loved it, though Susie pointed out that when Kara presents her food, she uses hollow words like ?fantastic? and ?great? way too much.

Meanwhile, Judson made potatoes encrusted with salmon and mascarpone?and goat cheese. ?The title alone should have secured him the win over Kara right then and there.

Bob said that the meal wasn?t memorable because the salmon was really the star instead of the potato. ?Susie said that it was layered and soulful, but that Judson lacks authenticity when he?s presenting his food, and comes off as if he?s talking to a room full of thousands.

Judson cried. ?Susie was not having it. ?That woman is made of stone, I tell ya! ?I love her!
In the end, ?Don?t Say Blacks? Kara was the one who took the long walk of shame through the darkened Food Network Star kitchen? the one that never has any butter on hand when the challenge that week is ?Make Something Spectacular with Butter!?

Poor Kara didn?t seem too surprised that the axe fell on her neck. ?Though the judges saw potential, they couldn?t find anything ?unique? that would make them want to watch any more. When they said that, I pursed my lips, looked down at my feet, and prayed for a reversal of fortune on next week?s Food Network Star.
