Kiobel and Unattractive Legal Arguments Against Corporate Liability Under the Alien Tort Statute

I am participating this week in a discussion on Kiobel v. Royal Dutch Petroleum, the case on corporate liability under the Alien Tort Statute that will be argued tomorrow at the Supreme Court, at the Manhattan Institute?s Point of Law Blog. ?My interlocutor will be Professor David Weissbrodt of the University of Minnesota. ?Here is a snippet of my opening salvo:

I will use two recent op-eds on the upcoming case to launch our discussion. Each op-ed reflects how the disputants in?Kiobel would like to frame their argument to the Supreme Court and to the public.

In the?NYT, Peter Weiss, formerly of the Center for Constitutional Rights, focuses on the importance of the ATS in holding human rights offenders accountable and the general unfairness of excluding corporations from ATS lawsuits.

In the?Washington Post, former Bush Administration State Department Legal Advisor John Bellinger, argues that ATS lawsuits are being used to harass corporations into settlements, to interfere with other nation?s domestic affairs, and to embroil the United States in disputes with important foreign allies like the United Kingdom, the Netherlands, and Germany.

I think Bellinger has a very strong argument (I have joined an?amicus brief in this case making very similar arguments) and I haven?t seen the petitioners in this case or their amici make a very persuasive response to it. If the Supreme Court rules against the Kiobel plaintiffs, I am betting some version of this argument will be in the majority opinion.

But it is also noteworthy that Bellinger does not respond to Weiss? claim about the unfairness of excluding corporations. He doesn?t do so because the ?corporations are not liable under the ATS,? is the kind of rigidly formalistic argument that rarely succeeds at the Supreme Court and has almost no appeal to the general public. The NYT headline to Weiss? op-ed, ?Should Corporations Have More Leeway to Kill Than People Do?,? neatly captures the difficulty that the Shell defendants face in making this argument.

But just because the argument is unattractive, doesn?t mean it is wrong.

Sunny Gold: Disney: Now in the Business of Shaming Fat Kids

In a most ill-advised and ham-fisted move, Disney has taken the fight against childhood obesity to new and horrific levels. Their secret weapon? The "Habit Heroes" exhibit that just debuted at Innoventions in Epcot.

On first glance, it looks like a good idea: Teaching kids to fight bad health habits -- personified as cartoon characters like scary-robot Control Freak who plays too many video games, or Sonic Boom, a DJ type who blows out his ear drums playing his headphones too loud. But as you flip through the gallery of enemies, you very quickly come upon three characters that are setting eating disorders educators like the Binge Eating Disorder Association on edge: Lead Bottom, the Glutton, and Snacker, three hugely fat and sinister characters that would make any overweight kid (let alone their parents!) feel ashamed.

It's enough to make anyone with a weight issue want to throw up their hands and dive into a box of Munchkins, and invite her friends to join. As Disney says in its description of Lead Bottom, "Blubbery loves company."

We all want kids to be healthy. But, as study after study has shown, shaming doesn't promote healthy weight loss, it promotes eating disorders. Which, not coincidentally, are on the rise in this country, right along with obesity. One in particular, binge-eating disorder, is more common than anorexia and bulimia combined, and has been in the American Psychological Association's DSM since 1994. Yet because of a lack of education, BED can sometimes be dismissed as "gluttony." (Hey, isn't that a Disney character?!)

Disney and its partner in this effort, Empire Blue Cross Blue Shield, have invested millions of dollars in this campaign. Too bad they didn't talk to the real stakeholders in this conversation, like obesity docs. It could've saved the company some embarrassment, and could've saved heavy kids a lot of pain.

Concrete is being reinvented as the preferred material to use in home construction as well as home d?cor. Concrete is no longer the boring grey and drab material but rather a flexible medium where it can be made to match any design material like stone, brick or even wood. This is especially true on driveways! With the use of stains, it can now be colored in different shades, an alternative to more expensive materials. It is also a material of choice when going green. Concrete is sustainable unlike wood and is actually recyclable. This is unlike carpet and vinyl tiles that pose a problem during its disposal and replacement. Stamped and stencilled concrete driveways are some of most common techniques converting concrete into a decorative concrete material. Stamped and stencilled concrete is done by adding texture to fresh concrete where it is made to resemble stone, brick wood or any design that the owner prefers. This is done by pressing moulds unto fresh concrete driveways where it is still mouldable. Brick patterns are the most commonly used but any pattern and design is possible. Colors can be added using dry shakes. Stenciled concrete gives the illusion of grout lines since it keeps the concrete free of color under the stencil. Powder released agents are also used in stamped concrete for easy removal of the mats. Whether stamping or stencilling your concrete driveway, applying a driveway sealer will help enhance the color and protect the concrete's surface. Although concrete is a relatively cheap and inexpensive material, applying decorative finishes can be quite expensive. It is best that steps are made to protect it. Sealing driveways will protect them from traffic especially heavy foot traffic and automobiles! There are basically two types of concrete sealers for external stamped and stenciled concrete, these are film forming sealers or penetrating sealers. Film forming sealers will protect the surface of the concrete driveway while penetrating sealers will soak into the concrete making it waterproof. Water-based are the preferred type of sealers to date since constructors are veering away from solvent type driveway sealer.

Cardinal Couple: Senior Day, Becky Burke

FRIDAY CARDINAL COUPLE

-Lady Cards, Becky Burke in final home game

The Cardinals take to the court at The KFC YUM! Center for the last time this season on Saturday, February 25 vs. DePaul with a 12:00 p.m. tip time. This is also Senior Day. Becky Burke is the only healthy senior on the squad and will play in front of her home court fans for the last time. Before we wish Becky farewell, perhaps we should take a small trip down memory lane to remember how she found her way to Louisville. Did you know that Becky was originally recruited by Coach Susan Walvius and signed to play with South Carolina? With a coaching change prior to her arrival to South Carolina, Becky re-opened her recruitment and found her way to the University of Louisville. Upon her arrival at Louisville Becky was quoted as stating that she ?brings energy, toughness and shooting? to the team. When asked what her Sport Center Highlight would be Becky stated, ?knocking down a 3 pointer at the buzzer to win the National Championship?.(Louisville Women's Basketball Media Guide, 2008-09) While that is not exactly the highlight reel to date, she came eerily close in her freshman year. In her freshman season Becky was known as a stand still shooter on the wing. Her job was to stand beyond the 3-point line, wait for Angel to kick the ball out and shoot her shot. She saw action in 38 games. Becky led her team at the foul line shooting 88.4%. Late in her freshman season she hit the proverbial freshman wall. She had a tough February, which garnered her a heart-to-heart talk with Coach Walz, and later Coach Norman. It was that talk with Coach Norman, Becky stated, that set the stage for Becky?s post -season play. Becky went on to have great post-season play, guarding some of the best players at the time in Kristi Toliver (of Maryland) and Whitney Hand (of Oklahoma). Becky hit some clutch 3 pointers in the game vs. Oklahoma and was on the only team in Louisville Women?s Basketball history to make it to the Championship game. While the Cards went on to lose that game against UCONN in St. Louis, it was an incredible run and the freshman who was supposed to be at South Carolina found herself on the national stage with the rest of her team celebrating an outstanding post-season run. Her sophomore season Becky started all 32 games. This was a rebuilding year for the Cards. Becky led the team in assists averaging 2.9 per game and ranked second on the team from the foul line at 80.4%. As Becky?s junior season rolled around and came to an end she had amassed staggering numbers as the 3 point baskets continued to drop and she shot a razor sharp 91% from the charity stripe. As Becky?s senior season quickly arrived, and has rapidly come close to the end of her career, she is just a shadow of the player that arrived on campus and to the Louisville community 4 years ago. Gone is the stand and shoot player on the wing, and instead a more mature, confident player who moves about the court. Over the years the ball handling has grown, defense has improved,the precision from beyond the arc has continued to grow, and Becky has learned to dribble penetrate and has continued razor sharp precision from the charity stripe. As the lone senior on this team, since the knee injury to Monique Reid, Becky has led by example stepping up to fill the gaps of injured teammates and transferred players. Becky surpassed the 1000 career point mark early this season against Murray State. In a very recent match up against Syracuse Becky further established her nickname as ?Big Shot Becky? knocking down 8 3 pointers tying four other players for the most 3 point baskets in a game. Becky is 12th on the all time scoring list with 1213 points and 3rd in career 3pt. goals at 235, 25 away from tying the second place holder, Sara Nord. While these are all very impressive numbers and Becky will long be remembered by Cardinal Fans as having a great 3 point shot and hitting big shots, when it counts, I will remember a few other things, too. As a fan, I do not know Becky personally. The above information was gathered from news articles over the course of the last 4 years. I did not interview Becky for this piece. I have met Becky over the course of the last 4 years on 4-5 different occasions. On every occasion, and a very recent occasion in the lobby of the YUM! Center after a volleyball game, Becky has been an approachable, gracious and appropriate face of the University. She has always been genuine in her small talk and went out of her way to meet my stepdaughter at the volleyball game when my stepdaughter not so subtly pointed across the lobby and at the top of her voice stated ?that?s Becky Burke!? The star-like status she has acquired over the years at Louisville has not dampened her approachability. I truly appreciate that, Becky. I appreciate that you took the time to go out of your way to introduce yourself and meet my kiddo. My guess is Becky has done that thousands of times over the course of her career. It makes an impression, and a difference, to young female athletes (my kiddo included). Thank you! Way back in her freshman year, at that heart to heart talk Becky had with Coach Norman, Coach Norman apparently asked Becky to come up with 5 positive attributes about herself. The news article went on to say that Becky had a hard time doing so, as she was in the middle of a bad stretch of her freshman year and was terribly down on herself. Coach Walz was quoted at this same time as stating, ?when you actually invest in this, you?re going to be a good player?.("Burke leap of faith pays off", ESPN, 2009) I think as Becky?s senior season comes to a close Coach Walz would say that Becky did invest, and she has become a good player. I also imagine Becky could easily come up with 5 things she likes about herself. If not, I have a few that come to mind:

DETROIT (AP) ? The U.S. Centers for Disease Control and Prevention issued a warning Thursday about using a common paint-stripping chemical to refinish bathtubs after tying it to 13 deaths in 10 states.

The CDC said the alert was based on research that began at Michigan State University. Scientists found 13 deaths between 2000 and 2011 of workers using products containing methylene chloride to strip paint from residential bathtubs. Three of the deaths were in Michigan, and the remaining 10 were reported in nine other states.

Methylene chloride is widely used as a degreaser and paint remover in industrial and home-improvement products.

"Each death occurred in a residential bathroom with inadequate ventilation," the CDC said in its Morbidity and Mortality Weekly Report. "Protective equipment, including a respirator, either was not used or was inadequate to protect against methylene chloride vapor."

The report said the chemical "has been recognized as potentially fatal to furniture strippers and factory workers but has not been reported previously as a cause of death among bathtub refinishers."

Using methylene chloride-based products in confined spaces like bathrooms presents great risks, the CDC said. It urged worker safety and public health agencies, manufacturers and trade groups to "communicate the extreme hazards" of their use to employers, workers and the public.

"Employers should strongly consider alternative methods of bathtub stripping," it said.

The alert's co-author, Michigan State's Kenneth Rosenman, said it is better to keep the chemical out of the bathroom. Its vapors are heavier than air and likely remain in bathtubs after each application.

"To use products containing methylene chloride safely, work areas must be well-ventilated, and when levels of methylene chloride exceed recommended exposure limits, workers must use protective equipment," Rosenman, chief of the school's Division of Occupational and Environmental Medicine, said in a statement Thursday. "In a small bathroom, it is unlikely these products can be used safely."

The co-author of the CDC warning, Michigan State industrial hygienist Debra Chester, first investigated the 2010 death of a 52-year-old man who owned a bathtub refinishing business. She then discovered two other Michigan deaths, leading to a National Institute for Occupational Safety and Health investigation that turned up 13 deaths.

Regulations Harm Small Business and Protects Corporations :

The prospects for conducting commerce are never an easy task. The hurdles to start a business much less stay competitive demands the greatest skill and fortitude. Innovation and inspiration often is the best course for those bold enough to become an employer. The idea that a level playing field exists for all comers is preposterous. The entire macrocosm for business rests upon separating your enterprise from that of your rivalries. Such is a basic lesson for those brave or foolish enough to enter the arena.

Courtney Rubin?cites the following in Inc. Magazine,

?Businesses with 20 employees or fewer pay 36 percent more than their larger counterparts (defined as those with 500 or more employees), says the?report?? called ?The Impact of Regulatory Costs on Small Firms? ? from the SBA?s Office of Advocacy. This is because a lot of costs are fixed ? the same whether you have two employees or 2,000. Total annual cost of following the rules for a small business: $10,585 per employee, or about $2,830 more than big business. Businesses with 20 to 499 employees paid about $7,454 per employee, or about $300 less than the largest companies.

The report estimates that 89 percent of all firms in the U.S. employ fewer than 20 workers. By comparison, large firms account for only 0.3 percent of all U.S. firms.

Says the report: ?If federal regulations place a differentially large cost on small business, this potentially causes inefficiencies in the structure of American enterprises, and the relocation of production facilities to less regulated countries, and adversely affects the international competitiveness of domestically produced American products and services.?

The screams for jobs, jobs and jobs would give the hint that federal, state and local business policy would favor the productive engine of employment. However, in the real world of political influence and favoritism only the well connected get the advantages.

Government regulations are meant to stifle competition. The legislative process graces those who are well connected, financially heeled and schooled in the art of writing the regulations. Few small businesses have a legal department or experienced lobbyists.

In Big Business and Big Government,?Timothy P. Carney?writes,

?As the federal government has progressively become larger over the decades, every significant introduction of government regulation, taxation, and spending has been to the benefit of some big business.?

Mr. Carney presents compelling evidence on the history of this axiom, in his article. The net result from this covert partnership of interest and rewards is the never ending campaign contribution cycle that finances every election. The small businessman seldom has the resources or crony relationships to wage off the grand strategies of the giant corporate model.

Their advantage stems not from mastering sound and creative business practices. On the contrary, the major corporations use their brute force to buy or stamp out any contender that dares compete for market share.

Access to capital or the lack thereof, dooms most small businesses. The burden of regulations only compounds the severity of the survival rate and burns up reserved funds which often cannot be replenished.?How can small business compete? ? offers this insight.

?Small business can?t control mass-market designs or brands, but we are well-placed to do what big business can?t:?Get inside the hearts and minds of our customers.?

As true as that advice resonates, the regulation landmines prevent small businesses from operating on a scale that can challenge all the advantages of the state sponsored conglomerates. The hard truth is that free enterprise is dead and in its place is an administered economy designed to suppress individually owned and managed businesses.

The prospects of reestablishing a political atmosphere that favors small business as the primary mechanism of job creation is remote as long as the transnational global and corporatist culture exists. Bigger is not better in most cases. Bigger usually means there are fewer companies in the same industry, accompanied with shrinkage in good paying jobs.

Theodore F. di Stefano?suggests four steps that small businesses need to focus upon,

1. Creating a Niche

A niche is a special quality or group of qualities that sets the small business apart from its larger competitors. It has also been described as a small, specialized business market.

2. Employee Training

If a small business is going to act as though the customer is truly special, its employees must be trained accordingly. Also, they must work for managers whom they respect and who respect them. They must not be put on the ?floor? to meet customers until they are thoroughly familiar with their product, be it food, auto services or any other product.

3. Management Philosophy

The owners of a small business must know the goals (mission) of their business and how they intend to achieve these goals. They should be clear about what segment of the market is their target and how they intend to appeal to that segment.

4. Good In-House Financial Management

You must be particularly aware of your current and projected cash position. And, you should certainly create a realistic annual budget for your company that serves as a financial road map for the future.

Now these common sense suggestions may assist in certain instances, but in a service economy, living wage jobs are rare at best. The regulations that drive business offshore also destroy a viable income scale. Reinstituting an American industrial and manufacturing base is a necessary step to climb out of this deep hole.

The regulatory climate must reflect policies that will benefit American workers. Open borders, that encourage illegal immigration, are a conscious regulatory policy that displaces domestic employees.

The regulations that slant and foster corporatist preference is the new feudalism. Is it not time to put Americans back to work? Without a political will to champion free enterprise and replace the corporate-state, only more suffering will thrive. It is up to the public to make this challenge the centerpiece for the 2012 elections.

NYC Public School Parents: The battle for the soul of a community ...

Nearly 500 parents, teachers, students, and community leaders filled the large auditorium, with more than 80 of them speaking out against this co-location proposal, and fewer than five parents from Brooklyn spoke out in support.? The rest of the audience consisted of parents bused in from the various Success charter schools in Harlem.??

And yet NYTimes/Schoolbook story ran a highly inaccurate and biased account, showing a large photo of the Success Academy parents, captioned with " parents turned out to support the co-location of a Success Academy charter school at J.H.S. 50 John D. Wells in Williamsburg, Brooklyn", without explaining that they were bused in by the charter operator from Harlem. The article went on to give most of its space to comments from the handful of supporters of the charter school, including the chain?s founder, Eva Moskowitz, with almost no mention of the huge outcry from the hundreds of community leaders, elected officials, and local parents who came out to oppose it. Opera bringing new versions of browsers to Mobile World Congress

Opera says it's going to bring new verisons of its mobile browsers -- Opera Mini and Opera Mobile -- to Mobile World Congress in a little more than a week. In an e-mail to press today, Opera says the new browsers will have features that "focus a lot on the social aspect of browsing."

Opera will come up with new versions of the Opera Mini and Mobile browsers whose new features will focus a lot on the social aspect of browsing. Opera has the highest market share when it comes to mobile browsing with more than 160 million active monthly users worldwide. Opera will also be making an announcement related to mobile payments which will democratize the area by bringing it to not just smartphone users.

School music provides a wealth of benefits | Davis Enterprise

About 30 years ago, Davis schools faced the biggest deficits on record up to that time. Significant cuts were made to the music program, and the school elementary music program was eliminated for three years.

This occurred in the years just before Davis passed its first school parcel tax in 1984. Once the elementary program was reinstated, it took another 10 years to restore the whole music program to its previous levels of participation and excellence.

We are also faced with a similar decision in 2012 as to whether to continue funding for programs like elementary music. But in light of how much Davis families appreciate that music performance is an essential component of a basic education, this is a choice that you can make at the ballot box.

When musicians rehearse together to make a piece of music work, there is no attention given to social differences among individuals. In our society, music and performing arts have been a refuge where individuals from historically marginalized groups ? based on economic class, race, ethnicity, gender, sexual orientation, political views, physical differences, mental and emotional challenges, character and personality, and religious faith ? have found public recognition and respect for their talent, inspiration and humanity.

In a school setting, students also find similar opportunities to connect with others through music programs. Because of the social acceptance they gain by participating in a team activity, students enrolled in school music programs are less likely to be involved in bullying or discipline issues.

Students also develop relationships with the community through public performances. They learn that their rehearsals and practice give them the confidence and ability to perform for others.

Through performance, students develop a positive public identity with their school. The community, both in Davis and beyond, more likely knows and recognizes the quality of Davis schools through public performances than by directly witnessing students? class work.

Davis schools have an excellent music program. The Davis High School music department was one of nine schools in the country to be honored as a Grammy Signature School. Although this award specifically honored the high school program, it reflected highly on the quality and breadth of the program that feeds the high school. Individual choir, band and orchestra groups from time to time receive equivalent recognition for their efforts.

The school music program has been reaching out to more students than ever before. Through donations, fundraising and grants, parents and music teachers have worked to acquire additional school instruments for students who need them.

High school music students have been paired with beginning elementary musicians to tutor and mentor them through their first years, especially targeting students who otherwise wouldn?t take private lessons. This has improved overall retention of students in the program.

In the past four years, most of the growth in the music program participation has taken place in the elementary grades, which now total almost 1,000 students in grades 4-6. With the passage of Measure C, those growing numbers would expand to the secondary grades.

Because of the nature of group performance, music classes can operate with more efficient staffing than most other subjects. A band, choir or orchestra class with 60 to 70 students is not unusual. However, an English class with that many students is considered scandalous.

Also, the more students who participate in the music program, the less a school district is burdened with spending on intervention programs. Students who participate in music through the secondary grades are more likely to attend school regularly, to perform better in other academic classes, to graduate and to go to college. They are less likely to be involved in drug abuse and other risky behavior.

As school districts make tough budgetary decisions, many choose to cut music programs because they are not assessed in standardized tests. If test scores in certain subjects don?t rise on schedule, then a school is defined as failing and the state and federal government step in to say how a school should be run.

But standardized tests measure a narrow range of success and ability. They don?t measure how well students work together nor how well they perform in front of others. They don?t measure artistic and esthetic sensibilities nor do they measure creativity.

We live in a time when, more than ever, students need a creative outlet, artistic development, performance experience, social stability and a positive model of teamwork, all of which music education provides.

If Measure C doesn?t pass, more than half of the district music program will be cut, including all of the elementary program. We ask you to vote to renew funding for a great, accessible school music program.

Vote yes on Measure C, so that our children will have a great education that provides more than just achieving good test scores.

FTC: Kids apps lacking privacy disclosures

Despite a huge number of mobile apps created for children, the Federal Trade Commission said Wednesday that there's "very little information" by many app developers when it comes to letting parents know about the personal data that's being collected about their children or information that's being shared. The agency said it plans an "additional review" in the next six months to see whether "some mobile apps" are violating the Children's Online Privacy Protection Rule.

In a report, "Mobile Apps for Kids: Current Privacy Disclosures are Disappointing," the FTC said that app stores, app developers "and third parties providing services" need to play "an active role in providing key information to parents" that they aren't now.

App developers "should provide data practices information in simple and short disclosures," the FTC said. "They also should disclose whether the app connects with social media, and whether it contains ads. Third parties that collect data also should disclose their privacy practices."

Mobile apps "can capture a broad range of user information from a mobile device automatically, including the user's precise geolocation, phone number, list of contacts, call logs, unique identifiers and other information stored on the device," the FTC said.

App stores, too should "take responsibility for ensuring that parents have basic information." The two largest, Apple's App Store and Google's Android Market, were studied by the FTC.

"As gatekeepers of the app marketplace, the app stores should do more," the agency said in the report:

The market for mobile applications has experienced explosive growth over the past three and a half years. When Apple?s iTunes App Store and Google?s Android Market first launched in 2008, smartphone users could choose from about 600 apps. Today, there are more than 500,000 apps in the Apple App Store and 380,000 apps in the Android Market, which consumers can access from a variety of mobile devices, including smartphones and tablets. Consumers have downloaded these apps more than 28 billion times, and young children and teens are increasingly embracing smartphone technology for entertainment and educational purposes.

A newly released Nielsen study corroborates the last part of the statement: In homes with tablets, a vast majority of children are using them.?

The FTC's study shows a huge number of mobile apps aimed at children, both in Apple's App Store and Google's Android Market.

The FTC's report coincides with the discovery in recent days about a flaw in Apple's iOS that lets apps access a user's address book contacts and store that data.?

Apple issued a statement Wednesday saying "any app wishing to access contact data will require explicit user approval in a future software release." But Reps. Henry Waxman (D-California) and G.K. Butterfield (D-North Carolina) sent a letter Tuesday to Apple, seeking answers on the issue.

The Children's Online Privacy Protection Rule (COPPA) was passed by Congress in 1998?? long before mobile apps and "practically the Paleozoic era of the Internet," as msnbc.com's Helen A.S. Popkin has noted. The law requires commercial websites to obtain parental permission before collecting the personal info of any user under the age of 13.

"Companies that operate in the mobile marketplace provide great benefits, but they must step up to the plate and provide easily accessible, basic information, so that parents can make informed decisions about the apps their kids use," said FTC chairman Jon Leibowitz in a press release. "Right now, it is almost impossible to figure out which apps collect data and what they do with it. The kids app ecosystem needs to wake up, and we want to work collaboratively with industry to help ensure parents have the information they need."
